Purchase rules

I. General provisions

  1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules"), upon their acceptance by the Buyer (after familiarizing themselves with the Rules and ticking the box next to the statement "I have familiarized myself with the "NANOGAMA" rules and agree with them"), are a binding legal document for the parties, which determine the Buyer's and Seller's rights and obligations, conditions of purchase and payment for goods, order of delivery and return of goods, responsibility of the parties and other provisions related to the purchase and sale of goods in the "NANOGAMA" online store.
  2. The seller reserves the right to change, amend or add to the Rules at any time, taking into account the requirements established by legal acts.
  3. By accepting the Rules, the buyer confirms that, based on point 4 of this section, he has the right to buy goods in the "NANOGAMA" online store.
  4. You have the right to buy in our online store:
  • able-bodied natural persons, that is, persons who have reached the age of majority, whose capacity is not limited by court order;
  • minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they dispose of their income independently;
  • legal entities;
  • authorized representatives of all the above-mentioned persons;

II. Protection of personal data

  1. When ordering goods, the buyer must specify his/her personal data necessary for the proper fulfillment of the goods order in the relevant information fields provided by the Seller: name, surname, delivery address, telephone number and e-mail address.
  2. By approving these Rules, the buyer agrees that his personal data referred to in point 1 of this section will be processed for the purpose of conducting proper electronic trade in the electronic store for the sale of goods and services "NANOGAMA".
  3. The Buyer, by agreeing to the processing of his personal data for the purpose of selling goods and services in the Seller's online store, also agrees to the sending of informational messages to the e-mail address and telephone number indicated by him, which are necessary to fulfill the order for goods.
  4. The buyer, who does not want his e-mail address and/or phone number to be used for the purpose of direct marketing, must inform the Seller about this by sending a message to the address info@nanogama.lt.
  5. The Seller confirms that the personal data specified by the Buyer will be processed only for the purpose of the sale of goods and services in the electronic store "NANOGAMA", the Seller's direct marketing and proper electronic trade. The Seller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Seller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data can be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.
  6. Pursuant to Clause 2 of Chapter IX of the Rules, the Buyer's identity document and the Buyer's data contained in it, provided to the Seller or Lithuanian Post employee, are used only for proper identification of the individual.

III. The moment of conclusion of the purchase-sale contract

  1. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after selecting the item(s) to be purchased and creating a shopping cart, clicks on the "Pay" link.
  2. Each purchase-sale contract concluded between the Buyer and the Seller is registered and stored in the database of the "NANOGAMA" online store.

IV. Buyer's rights

  1. The buyer has the right to buy goods in the "NANOGAMA" online store in accordance with the procedure set forth in these Rules and other information sections of the Seller's online store.
  2. In accordance with the provisions of the legal acts of the Republic of Lithuania, which regulate the legal relations between the Seller and the Buyer, the Buyer has the right to refuse the contract for the purchase and sale of goods concluded with the "NANOGAMA" online store, by notifying the Seller in writing (by e-mail, specifying the item to be returned and its order number) no no later than within 30 (thirty) days from the day of delivery of the goods.
  3. The Buyer may exercise the right provided for in point 2 of this section of the Rules only if the product has not been damaged or has not substantially changed its appearance, nor has it been used.

V. Obligations of the Buyer

  1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
  2. If the data provided in the registration form of the registered Buyer changes, he must update them immediately.
  3. The buyer, using the "NANOGAMA" online store, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.

VI. Seller's rights

  1. If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.
  2. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
  3. The Seller has the right to cancel his order without prior notice to the Buyer, if the Buyer does not pay for the goods within 7 (seven) days.

VII. Obligations of the seller

  1. The Seller undertakes to enable the Buyer to use the services provided by the "NANOGAMA" online store under the conditions set out in these Rules and the online store.
  2. The Seller undertakes to respect the Buyer's right to privacy regarding his personal information, that is, to process the personal data specified by the Buyer only in accordance with Chapter II of the Rules and the procedure established by the legal acts of the Republic of Lithuania.
  3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Chapter IX of the Rules.
  4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, the Seller undertakes to return the money paid to the Buyer within 7 (seven) working days, if prepayment was made.
  5. After the Buyer exercises the right provided for in Clause 2 of Chapter IV of the Rules and under the conditions stipulated in Clause 3 of Chapter XI of the Rules, the Seller undertakes to return the money paid to the Buyer within 7 (seven) working days, calculated from the day of receipt of the returned goods.

VIII. Product prices, payment procedure and terms

  1. The prices of goods in the online store and in the formed order are indicated in Euros with VAT.
  2. The buyer pays for the goods in the following ways: payment by credit card; payment using Paypal payment system or payment by bank transfer.
  3. The order is executed and the delivery period starts counting only after receiving the payment for the goods.

IX. Delivery of goods

  1. When ordering goods, the buyer can choose one of the specified methods of delivery of the goods.
  2. Delivery of goods to the Buyer:
  • The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
  • The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity. When picking up the goods, it is necessary to have with you and present to the authorized employee a valid identity document (identity card, passport or new model driver's license).
  • The goods are delivered by the Seller or his authorized representative.
  • The Seller provides the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.
  • In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
  • During the delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the shipment and the goods(s) and sign the shipment transfer - acceptance document. After the buyer signs the shipment transfer - acceptance document, it is considered that the shipment is delivered in a suitable condition, there are no product damages, the origin of which cannot be attributed to a factory defect, and there are no inconsistencies in the product(s) assembly (such as can be determined during the external inspection of the goods). Having noticed that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the Buyer must note this in the shipment transfer - acceptance document and , in the presence of the Seller or his representative, to draw up a free-form act of violation/nonconformities of the shipment and/or product(s). If the Buyer does not perform these actions, the Seller is released from responsibility towards the Buyer for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined during an external inspection of the goods.

X. Quality of goods

  1. The characteristics of each product sold by "NANOGAMA" are generally indicated in the product description attached to each product.
  2. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.

XI. Return and exchange of goods

  1. Defects of the sold goods are removed, low-quality goods are replaced and returned in accordance with the provisions of the legal acts of the Republic of Lithuania.
  2. The Buyer may return the goods within 30 (thirty) days from the day of delivery of the goods to him, informing the Seller about this in accordance with the procedure provided for in Section IV, Clause 2.
  3. When returning goods to the buyer, it is necessary to comply with the following conditions:
  • the returned product must be in its original, neat packaging (this clause does not apply in the case of a defective product being returned);
  • the product must be undamaged by the Buyer;
  • the item must be unused, without losing its merchandise appearance (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective item);
  • the returned item must be in the same configuration as the one received by the Buyer;
  • when returning the product, it is necessary to present the document of its purchase.
  1. The Seller has the right not to accept the goods returned by the Buyer, if the Buyer does not follow the procedure for returning the goods specified in this section of the Rules.
  2. In all cases, money for returned goods is transferred by payment order and only to the payer's bank account within 7 working days.
  3. If the returned or exchanged goods are of good quality and correspond to the order, the costs of returning the goods shall be paid by the Buyer. We can accept returned goods through the Omniva postal machine using the Flipo.lt system, the price is €2.00 (we will deduct this amount from the returned amount for the goods).
  4. In the event that the reason for the return of the product is inadequate quality, we undertake to replace the product of inadequate quality with a product of adequate quality at our own expense or return the money paid for the product.

XII. Responsibility

  1. The buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer does not provide accurate personal data, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.
  2. The buyer is responsible for the actions taken while using this online store.
  3. After registering, the Buyer is responsible for transferring his login data to third parties. If the services provided by "NANOGAMA" are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
  4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
  5. In the event of damage, the guilty party compensates the other party for direct losses.

XIII. Final Provisions

  1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
  2. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
  3. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
